Inspect Canada and Johnni: Terms of Service

Version: 1.1 First published: April 1, 2026

This version takes effect: September 30, 2026 Last Updated: September 30, 2026

These Terms of Service (“Terms”) form a binding agreement between you (“you,” “your,” “User”) and In Spect Building Consultants Inc., a British Columbia corporation operating as Inspect Canada (“Inspect Canada,” “we,” “us,” “our”), with offices at 100 Park Royal S Unit 200, West Vancouver, BC V7T 1A2, Canada.

By downloading, installing, accessing, or using the Inspect Canada mobile application (the “App”), the Inspect Canada website at inspect.ca, the Strata Review service at strata.inspect.ca, or any related service (collectively, the “Services”), you agree to these Terms. If you do not agree, do not use the Services.

1. About Inspect Canada

Inspect Canada is a Canadian platform offering technology tools and information services for homeowners, real estate agents, home inspectors, and related professionals. Our Services include – but are not limited to – AI-assisted photo analysis, repair price estimates, trade directory listings, strata document review, home inspection booking, virtual consultations, digital inspection reports, the Johnni home assistant, home profiles, and home maintenance plans.

These Terms apply to both of our mobile applications: Johnni, for homeowners, and Inspect Canada, for real estate agents, and to the related websites. “App” means either application. Each application accepts only the kind of account it is made for.

Important distinction. Most Services offered through the platform are informational technology services. A licensed home inspection is performed when it is booked as such, or when what is done amounts to a home inspection under the applicable regulation, whatever the service is called. A home inspection is conducted under a separate written Inspection Agreement between you and the inspector. Outside of home inspections, our Services are not the practice of a regulated profession, and use of the Services does not create a professional-client, fiduciary, or agency relationship.

In Spect Building Consultants Inc. does perform licensed home inspections in British Columbia under the Home Inspector Licensing Regulation. Those services are governed by the Inspection Agreement, not these Terms.

2. Acceptance of Terms

You confirm that you have read, understood, and agreed to these Terms by:

  • Creating an account in the App or on our websites; or

  • Tapping “I Agree” or any equivalent button; or

  • Continuing to use the Services after these Terms become effective.

If you are using the Services on behalf of a business, brokerage, strata corporation, or other organization, you represent that you have authority to bind that organization to these Terms.

3. Eligibility

You must be at least 19 years of age (the age of majority in British Columbia) to use the Services. By using the Services, you represent that you meet this requirement.

We do not knowingly collect information from anyone under 19. If we learn that a minor has registered an account, we will deactivate it.

You must not be located in, ordinarily resident in, or a national of, any country subject to Canadian or U.S. trade sanctions or embargo, and you must not be on any list of restricted parties maintained by the Canadian or U.S. governments.

4. Your Account

To use most Services, you must register an account using a valid email address. You agree to:

  • Provide accurate and complete information;

  • Keep your login credentials confidential;

  • Notify us promptly at support@inspect.ca if you suspect unauthorized access;

  • Be responsible for all activity that occurs under your account.

We may suspend or terminate accounts that violate these Terms, are inactive for extended periods, are used fraudulently, or otherwise pose risk to other Users or the Services.

You may delete your account at any time from within the App (Menu, Profile, Delete My Account) or by emailing support@inspect.ca. Deleting your account cancels a paid plan so that it does not renew. Deletion is subject to the retention provisions in our Privacy Policy.

5. General Service Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.

The Services use artificial intelligence (AI), machine learning, and automated computational tools to generate analysis, suggestions, recommendations, estimates, and summaries.

AI Hallucination and Error Acknowledgement. AI output is probabilistic. AI-generated content may contain fabricated, incorrect, incomplete, outdated, biased, or misleading information, including statements that appear authoritative but are not supported by the underlying data, source documents, or real-world conditions. You acknowledge that AI is not a substitute for inspection, evaluation, or advice by a qualified human professional, and that the very nature of generative AI means errors will occur, sometimes without obvious indication. You agree to independently verify any AI output before relying on it for any decision.

Not an Emergency Service. The Platform and Services are not emergency services and must not be used as a substitute for one. In an emergency involving fire, smoke, gas leak, carbon-monoxide alarm, structural instability, flooding, sewage backup, electrical hazard, criminal activity, threat to health or safety, or any other situation requiring immediate response – call 9-1-1 (or your local emergency number) and contact appropriate licensed professionals immediately. Do not wait for AI analysis, a Strata Review, an inspection booking, or any other Service response.

We do not warrant that the Services will be free of defects, viruses, or interruptions, nor that any defects in the Services will be corrected.

6. Service-Specific Terms

In addition to the general disclaimer above, the following terms apply to specific Services. Where multiple Services apply, all relevant disclaimers apply cumulatively.

6.1 Photo Analysis & Defect Detection

The App allows you to upload photos of property components (e.g., siding, electrical, plumbing, mechanical) for analysis by our AI system. The system attempts to identify potential issues, defects, or maintenance items and may suggest trade categories.

You acknowledge that:

  • Photo analysis is not a home inspection and does not satisfy any legal, contractual, or insurance requirement for an inspection.

  • The AI may misidentify, fail to identify, or incorrectly classify issues. False positives and false negatives are expected.

  • Results depend heavily on photo angle, lighting, and resolution.

  • The AI cannot detect issues outside the photo frame, behind surfaces, in concealed systems, or in components not photographed.

  • You should not make purchase, sale, repair, or renovation decisions based solely on photo analysis output.

6.2 Repair Price Estimates (“RepairPricer”)

The App provides estimated cost ranges for repairs identified through photo analysis, AI suggestions, or inspection reports. These estimates are algorithmic approximations derived from public market data, historical averages, and AI inference. They are not produced by a contractor, an estimator, or any licensed professional, and they are not based on physical inspection of your property.

You acknowledge that:

  • Estimates are rough, illustrative, algorithmic approximations – not quotes, bids, offers, contracts, or representations of actual cost.

  • Estimates may be materially inaccurate in either direction.

  • Hidden, latent, or concealed conditions can drastically change actual cost, sometimes by an order of magnitude. Examples include hidden water damage, asbestos, knob-and-tube wiring, structural deficiencies, code-compliance upgrades triggered by a permit, and supply-chain disruptions.

  • Actual repair costs vary significantly based on geography, contractor availability, materials cost, scope of work, accessibility, season, permitting, and conditions discovered during repair.

  • Estimates are not suitable for budgeting, mortgage or financing decisions, insurance claims, real estate negotiation, purchase or sale decisions, court evidence, or any other decision with financial, legal, or contractual consequence.

  • An estimate from Inspect Canada is not an offer to perform work at the estimated price by Inspect Canada or any third party.

  • For any decision that depends on cost, you must obtain multiple independent written quotes from licensed contractors who have physically assessed the specific work at the specific property.

  • Inspect Canada is not liable for any difference between an estimate and the actual price you pay any contractor, nor for any decision made in reliance on an estimate.

6.3 Trade Directory & Recommendations

The App and the Inspect Canada website list third-party trade professionals (plumbers, electricians, roofers, HVAC technicians, and others). When AI defect analysis identifies an issue, the App may suggest one or more trade categories or specific listings.

Marketplace nature; not an endorsement. The directory is informational only. Listings, ordering, ranking, badges, highlights, and recommendations:

  • are produced by software and editorial choices made by Inspect Canada and do not constitute a recommendation or endorsement of any particular trade;

  • may include sponsored placements, paid features, paid prioritization, paid badges, referral arrangements, and commercial relationships between Inspect Canada and the listed trade or its affiliates;

  • may change at any time without notice; and

  • are not a representation that any specific trade is the best, the cheapest, the safest, the most qualified, the closest, or in any way superior to any trade not listed.

You acknowledge that:

  • Listed trades are independent third parties – not employees, agents, partners, joint venturers, representatives, or affiliates of Inspect Canada – and Inspect Canada is not a party to any contract between you and a trade.

  • Featured listings. A listing marked “Featured” is shown ahead of others. A Featured listing may be a paid placement.

  • How trades are chosen. We choose trades for the directory from businesses with high ratings on Google and a good reputation, and we follow up with clients after work is done to ask whether they were satisfied. A trade we receive poor reports about may be removed.

  • What we do not do. We do not check or confirm a trade’s licence, insurance, bonding, or background, and we do not supervise, employ, train, control, monitor, or guarantee any listed trade or any work they perform. Ratings and reputation are other people’s opinions at a point in time; they can be wrong or out of date.

  • The fact that a trade appears in the directory is not a representation that they are currently licensed, currently insured, currently in good standing with any regulator, free of complaints or judgments, or qualified for any specific work.

  • Any contract, transaction, payment, deposit, lien, warranty, dispute, or claim relating to work performed, materials supplied, or representations made by a listed trade is solely between you and that trade.

  • Inspect Canada is not liable for the quality, timeliness, cost, safety, completeness, lawfulness, code-compliance, warranty, conduct, or outcome of any work performed, materials supplied, advice given, communication made, or representation made by a listed trade, nor for any property damage, personal injury, financial loss, or other harm caused by a listed trade.

No warranty of trade availability or response. Inspect Canada does not guarantee the availability, response time, willingness to take on a job, pricing consistency, geographic coverage, or continued participation of any listed trade. Trades may decline jobs, change pricing, change service areas, become unavailable, or be removed from the directory at any time and without notice.

You are responsible for independently verifying the licensing, bonding, insurance, references, work history, complaint history, and qualifications of any trade you engage before contracting with them, and for obtaining multiple independent written quotes. Inspect Canada strongly recommends checking the trade’s standing with the relevant provincial regulator (e.g., Technical Safety BC for gas/electrical, the Canadian Home Builders’ Association, the Better Business Bureau) and confirming insurance with a current certificate from the insurer.

6.4 Strata Review

The Strata Review service (available through the App and at strata.inspect.ca) analyzes strata documents you upload – including bylaws, financial statements, depreciation reports, engineering reports, meeting minutes, Form B disclosure statements, and similar – and produces an AI-assisted summary highlighting potential risks, recurring themes, reserve fund status, capital projects, and related observations.

You acknowledge that:

  • A Strata Review report is not legal advice, not engineering advice, not a building inspection, not a depreciation report, not a reserve fund study, not a strata document review by a lawyer or notary, not due diligence, and not a substitute for any of the foregoing.

  • Use of the Strata Review service does not create a lawyer-client, engineer-client, fiduciary, or agency relationship between you and Inspect Canada. Inspect Canada owes you no fiduciary duty in connection with a Strata Review report.

  • The AI may misread, misinterpret, miss, omit, or misattribute information from the source documents. Important information may be omitted entirely from the summary. Important information may also be misstated.

  • The accuracy of the report depends on the quality, completeness, and legibility of the documents you provide. Missing, redacted, illegible, withheld, or out-of-date documents produce incomplete reports – and the report itself may not flag what is missing.

  • A Strata Review report is not a representation, warranty, or guarantee about the building, the strata corporation, future levies, future special assessments, future insurance availability or premiums, future litigation, future operating costs, current or future building-envelope condition, mould, water-ingress history, depreciation-report adequacy, contingency-fund adequacy, financial solvency, governance quality, council conduct, or any other present or future fact. It is an AI-assisted summary of documents only.

  • The AI cannot determine future building performance or predict whether issues identified (or not identified) in the source documents will materialize, worsen, or be remediated.

  • You must independently review the underlying strata documents and consult qualified professionals – including a BC real-estate lawyer, a BC-licensed home inspector, an engineer where applicable, and your real-estate agent – before relying on the report for any real-estate, financial, insurance, or legal decision.

  • Strata corporations and individuals named in source documents have rights under privacy law. By uploading documents, you represent that you are authorized to do so (e.g., as a unit owner, prospective buyer with seller’s consent, or buyer’s agent acting under client instruction) and you accept full responsibility for ensuring that your upload is lawful.

  • The strata regulatory framework in British Columbia (the Strata Property Act and regulations) is complex. Nothing in a Strata Review report constitutes legal interpretation of the Strata Property Act or any related regulation, bylaw, rule, or court decision.

6.5 Home Inspection Booking

The App and our websites allow you to book home inspection services. Home inspections booked through the platform may be performed either by In Spect Building Consultants Inc. (a BC-licensed home-inspection provider) or by independent inspectors operating under their own separate licensing, insurance, and contractual arrangements. The inspector identity will be disclosed before you confirm the booking and in the Inspection Agreement.

You acknowledge that:

  • The terms governing the inspection itself (scope, limitations, liability, deliverables, fees, cancellation, dispute resolution) are set out in the Inspection Agreement signed at the time of booking. The Inspection Agreement prevails over these Terms for any matter specific to the inspection.

  • The Inspection Agreement identifies the parties providing and contracting for the inspection and describes Inspect Canada’s role.

  • Booking through the App is a request for service. A binding inspection contract is formed only upon inspector confirmation and your acceptance of the Inspection Agreement.

  • Estimated arrival times, durations, services, and fees displayed during booking are estimates, subject to change based on site conditions and disclosed property characteristics.

  • Cancellation, rescheduling, and refund policies are governed by the Inspection Agreement and our then-current cancellation policy.

6.6 Virtual Inspection / Virtual Consultation

Virtual Consultation sessions (“VC”) are live or recorded video sessions with a person identified as an inspector or building consultant. VC sessions provide general guidance and visual observations only.

You acknowledge that:

  • A VC session is a conversation about a home by video or phone. It does not include attending the property.

  • Whether an activity is a home inspection depends on what is done, not on what it is called. Where a session amounts to a home inspection under the Home Inspector Licensing Regulation of British Columbia or an equivalent regulation, it is performed by a licensed inspector under a written inspection contract, and a report is provided as that regulation requires. Otherwise a VC session does not produce a home inspection report.

  • The inspector cannot test systems, access concealed spaces, operate equipment, take measurements, or perform any task requiring physical presence.

  • VC output is informational. Decisions made based on a VC session are made at your own risk.

6.7 Appliance Age Finder

The Age Finder feature estimates manufacture date of an appliance from a photo of its data/identification plate.

You acknowledge that:

  • Age estimates are best-effort interpretations of serial-number patterns and may be wrong.

  • The actual remaining useful life of an appliance depends on usage, maintenance, environment, and installation, none of which the Age Finder can assess.

6.8 Inspection Reports & Client Portal

The App may display home inspection reports prepared by Inspect Canada or by inspectors using our InspectVault platform. These reports are governed by the Inspection Agreement signed at the time of the inspection. Nothing in the App alters, replaces, or supplements the report itself.

If the App displays a report prepared by a third-party inspector, Inspect Canada is solely providing a display surface and is not the author of, and is not responsible for, the contents of that report.

6.9 Johnni Home Assistant (Chat and Voice)

Johnni is an AI assistant that answers questions about a home using the information in your Home Profile, your inspection report, and general home-maintenance knowledge. You can type or speak to Johnni, and Johnni can reply in text or aloud.

You acknowledge that:

  • Johnni’s answers are generated by AI and may be wrong, incomplete, or out of date, including statements about the age, condition, remaining life, safety, or cost of any part of a home.
  • Johnni has not seen your home. It works from records and from what you tell it. Conditions change after an inspection, and Johnni does not know about changes that are not in its records.
  • Johnni does not diagnose defects, confirm that something is safe, or replace an inspection, a repair estimate, or advice from a licensed professional. Before you act on an answer that affects safety, cost, or a purchase or sale, confirm it with a qualified professional.
  • When you speak to Johnni, the microphone also picks up other voices and sounds near your device. These may be transcribed and answered as if they were your words. Use Mute or End to stop listening.
  • Johnni can open screens in the App when you ask. It does not book, buy, send a message, or contact a trade on your behalf without a separate confirmation from you.
  • Do not use Johnni in an emergency. Section 5 (Not an Emergency Service) applies.

You can report an answer you believe is wrong, unsafe, or offensive with “Report this answer”. We review reports, and we are not obliged to respond to each one.

The first time you sign in we ask for your permission to share what you send with our AI providers. Without it, Johnni’s answers, tasks, tools, and photo checks are not available; your inspection report, your profile, and account deletion are. The Privacy Policy explains what is shared, how long conversation records are kept, and how to withdraw permission.

6.10 Home Profile and Maintenance Plan

The Home Profile is a record of your home’s components, built from your inspection report, from photos and details you add, and from general information about homes of a similar age and type. The Maintenance Plan suggests tasks, by month, based on that record.

You acknowledge that:

  • The Home Profile may contain errors or be incomplete. You are responsible for checking details that matter to you and correcting them.
  • Suggested tasks and their timing are general guidance. They are not a complete list of the maintenance your home needs, and a task not being listed does not mean it is not needed.
  • Marking a task as done, or a photo check returning a good result, is a record for your own use. It is not confirmation by Inspect Canada that the work was done correctly or that the component is in good condition.
  • You are responsible for maintaining your home and for following the manufacturer’s instructions, your strata’s rules, and applicable codes. Some tasks involve risk; do not attempt work you are not qualified to do safely.
  • Repair-cost ranges shown with a task or a finding are examples. They are not quotes.

If you transfer a home to a new owner, the new owner receives the whole home’s record, including every service event and photo check with the notes and photos you attached; parts of it cannot be held back. Your account name and contact fields are not transferred separately, and your tasks and conversations are not transferred. Notes and photos you transfer may contain personal information. If there is a note or photo you do not want passed on, ask us to remove it and wait until we confirm it has been removed before you create a handoff code. You confirm that you are entitled to share what is in the record.

After a transfer, the record belongs to the new owner’s account. A former owner may ask us to remove personal information in a note or photo they added; we confirm the request comes from the account that added it. We do not delete the new owner’s record, or entries the new owner added, at a former owner’s request.

6.11 Savings and Partner Offers

The App may show offers from third-party businesses (“Partners”), such as discounts on insurance, telecommunications, or home services.

  • Offers are made by the Partner, not by Inspect Canada. The Partner sets the terms, eligibility, price, and availability, and may change or withdraw an offer at any time.
  • Amounts shown in the App, including any total such as “up to” a dollar figure, are estimates of the most that could be saved if every offer were used. They are not a promise of savings.
  • Any purchase or contract you make is between you and the Partner. Inspect Canada is not a party to it and is not responsible for the Partner’s products, services, or conduct.
  • Inspect Canada may receive a fee or commission from a Partner when you take up an offer.
  • When you open an offer, you leave the App. The Partner’s own terms and privacy policy apply.

7. No Professional Advice, No Reliance, No Fiduciary Relationship

7.1 No Professional Advice

Except where you have engaged us under a separate written professional-services agreement (such as an Inspection Agreement), nothing in the Services constitutes:

  • Real-estate advice or representation;

  • Legal advice (including interpretation of the Strata Property Act, Real Estate Services Act, Residential Tenancy Act, or any other statute);

  • Engineering, structural, geotechnical, or building-envelope advice;

  • Building-science or building-code interpretation;

  • Insurance advice or insurability determinations;

  • Financial, mortgage, investment, lending, or appraisal advice;

  • Medical advice (e.g., regarding mould, asbestos, lead, radon, or environmental hazards);

  • Pest-control advice; or

  • Any other regulated professional advice.

You should consult appropriately licensed professionals before making decisions that affect your legal rights, financial position, health, or safety.

7.2 Verify Before You Rely

Services output is information to help you decide; it is not a substitute for your own judgment or for a qualified professional. Before you rely on Services output for a decision that affects safety, a significant cost, or the purchase or sale of a property, verify it with a qualified professional. To the extent the law permits, Inspect Canada is not responsible for loss that results from relying on Services output without doing so. This Section does not apply to a home inspection performed under an Inspection Agreement, and it does not limit our responsibility for our own negligence where the law does not allow that responsibility to be limited.

7.3 No Fiduciary or Agency Relationship

Use of the Services does not create a fiduciary, agency, partnership, joint-venture, employer-employee, advisor-client, or trust relationship between you and Inspect Canada. Inspect Canada owes no fiduciary duty in connection with the Services.

7.4 No Real-Estate Transaction Warranty

The Services are technology and information tools. They are not a substitute for due diligence in a real-estate transaction. Inspect Canada makes no representation, warranty, or guarantee – express or implied – about any property, listing, transaction, counterparty, agent, brokerage, lender, strata corporation, or contractor referenced in or accessed through the Services. Outcomes of real-estate transactions are inherently uncertain. Nothing in the Services constitutes a recommendation to buy, sell, lease, finance, refinance, or insure any property.

8. User Content

“User Content” means any photo, video, document, text, audio, location, contact information, or other content you submit, upload, transmit, or store through the Services – including but not limited to photos uploaded for analysis, strata documents uploaded for review, inspection notes, addresses, and messages.

8.1 Ownership

You retain ownership of your User Content.

8.2 Licence to Inspect Canada

By submitting User Content, you grant Inspect Canada a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, process, copy, transmit, display, and analyze the User Content to the extent necessary to:

  • Provide the Services to you;

  • Operate, maintain, secure, and improve the Services;

  • Improve the Services using information in de-identified or aggregated form, as described in Sections 3(b) and 5.2 of our Privacy Policy. This licence does not permit us to use your identifiable content, including raw reports, documents, photos, or conversations, to train an AI model without your specific written consent;

  • Generate de-identified aggregate insights and statistics;

  • Comply with legal obligations.

8.3 Your Representations

You represent and warrant that:

  • You own the User Content or have all rights, permissions, and consents necessary to submit it and grant the licence above;

  • Your User Content does not violate any law, contract, court order, or third-party right (including privacy, publicity, intellectual property, and confidentiality rights);

  • Strata documents you upload were lawfully obtained and you have the right to share them with us for the purpose of producing a Strata Review report.

8.4 Removal

We may, but are not obligated to, remove, refuse to host, or terminate access to any User Content that we reasonably believe violates these Terms or applicable law.

9. Acceptable Use and User-Content Safety

9.1 Prohibited Uses

You agree not to:

  • Use the Services for any unlawful, fraudulent, harmful, harassing, deceptive, threatening, or hateful purpose;

  • Use the Services to discriminate or to engage in conduct that violates the Canadian Human Rights Act, the BC Human Rights Code, or equivalent law;

  • Attempt to reverse-engineer, decompile, scrape, or extract code from the App or websites except as expressly permitted by applicable law;

  • Use bots, scrapers, or other automated means to access the Services, except for documented public APIs;

  • Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Services, related infrastructure, or any other user’s account;

  • Misrepresent your identity, role (e.g., as an inspector, agent, brokerage, or strata council member), or affiliation;

  • Use the Services to create a competing service, dataset, or AI model, or to train any machine-learning model;

  • Resell, sublicense, or commercially exploit the Services or content obtained from the Services without our prior written consent;

  • Remove, obscure, or alter any proprietary notices in the Services; or

  • Use the Services in any way that could expose Inspect Canada to regulatory liability, including engaging in the practice of a regulated profession through the Services.

9.2 Prohibited User Content

You must not upload, submit, or transmit any User Content that:

  • Is illegal under Canadian law or the law of the place where you are located;

  • Contains defamatory, obscene, pornographic, sexually explicit, hateful, or violent material;

  • Depicts or sexualizes minors in any way;

  • Is harassing, abusive, threatening, or intended to bully another person;

  • Infringes any copyright, trademark, patent, trade-secret, or other intellectual-property right;

  • Discloses confidential, personal, financial, medical, or proprietary information of a third party without authorization (for example, strata documents you have no right to share, or photos of the inside of a home you do not own or have permission to photograph);

  • Contains malicious code, viruses, or material designed to interfere with the operation of any system;

  • Misrepresents the subject of a property, inspection, or strata document;

  • Falsely identifies another person or impersonates a real-estate professional, inspector, lawyer, council member, or regulator.

9.3 Moderation, Removal, and Reporting

Inspect Canada may, at any time and in our sole discretion, review, remove, refuse to host, label, or restrict access to any User Content we reasonably believe violates these Terms or applicable law, and may suspend or terminate the account responsible. We may also report illegal content to law enforcement or to a regulator.

To report content that violates these Terms – including content you believe is illegal, infringing, abusive, or otherwise objectionable – email support@inspect.ca with the subject line “Content Report”, identifying the content and the basis for the report. We aim to respond within 5 business days. Reports about copyright are handled under Section 9.4 below.

9.4 Copyright Notices and Counter-Notices

If you believe your copyright has been infringed by content available through the Services, send a written notice to support@inspect.ca with the subject “Copyright Notice”, containing:

  • Your name, mailing address, telephone number, and email address;

  • A description of the copyrighted work you claim has been infringed;

  • A description and location (URL or in-App path) of the allegedly infringing material;

  • A statement, made in good faith, that the use is not authorized by the copyright owner, its agent, or the law;

  • A statement, made under penalty of perjury or its Canadian equivalent, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner; and

  • Your electronic or physical signature.

Canada’s Copyright Act uses a “notice and notice” regime. On receipt of a compliant notice, we will forward the notice to the user responsible for the content (where we can identify them) and retain records of the notice as required by law. We may also remove or restrict the content at our discretion. Repeated or fraudulent notices may result in account suspension or legal consequence under the Copyright Act. A user who has received a notice may submit a counter-notice to the same address.

10. Third-Party Services & Links

The Services interoperate with or link to third-party services, including Apple, Google, Firebase, OpenAI, Anthropic, Google Cloud, and our trade directory partners. Your use of those services is governed by their respective terms and privacy policies. Inspect Canada is not responsible for third-party services.

When you choose to share content (e.g., emailing a Strata Review report or sharing an inspection report), Inspect Canada is not responsible for what the recipient does with that content.

11. Referring Agents, Inspectors, Brokerages, and Third-Party Distributors

The Services may be shared, promoted, recommended, distributed, co-branded, or – in some cases – white-labelled by real-estate agents, brokerages, home inspectors, contractors, strata management companies, lenders, insurers, or other third parties (collectively, “Referring Parties”). A Referring Party may appear in the App as the inspector or agent who “shared” the App with you, may have their branding displayed in your account, or may have provided you with a link or QR code to download the App.

You acknowledge and agree that:

  • Referring Parties are not the developers, operators, owners, hosts, or providers of the Services. Unless expressly stated, the Services are operated solely by Inspect Canada.

  • Referring Parties do not control the operation, outputs, AI models, recommendations, estimates, trade listings, strata analyses, content, availability, accuracy, uptime, security, or any other functionality of the Services.

  • Referring Parties are not responsible for:

  • Any AI-generated output, photo analysis, repair price estimate, trade recommendation, Strata Review summary, age-finder result, or any other output of the Services;

  • Any technical issue, defect, outage, error, omission, interruption, data loss, or security incident affecting the Services;

  • Any decision you make – or refrain from making – based on the Services;

  • The acts or omissions of any other Referring Party, listed trade, third-party inspector, agent, brokerage, lender, or counterparty;

  • The contents of any inspection report, Strata Review report, or other deliverable produced through the Services, except where that specific Referring Party is the named author or signatory of that deliverable.

  • Your use of the Services does not create any partnership, joint venture, agency, fiduciary, employment, or professional-advisory relationship between you and any Referring Party.

Limitation of Referring Party Liability. To the maximum extent permitted by applicable law, no Referring Party will have any liability arising from or related to your use of the Services, the Services themselves, or any Service output. Each Referring Party is an intended third-party beneficiary of this Section and Section 14 (Limitation of Liability) and may enforce these provisions directly.

Your Own Direct Relationship. Nothing in this Section affects any direct contract you have with a Referring Party for services that party performs in their own name – for example, a buyer’s-agent representation agreement, a home-inspection contract you sign with a specific inspector, or a brokerage’s listing agreement. Those direct relationships are governed by their own separate agreements.

12. Fees, Plans, and Allowances

12.1 Johnni. Johnni is free for homeowners. Booking an inspection, including an annual maintenance inspection, is a paid in-person service; the price is shown before you confirm, and the service is governed by the Inspection Agreement.

12.2 Inspect Canada (agents). A free account includes a monthly allowance of uses for each tool. The current allowance is shown in the App under Profile. Allowances start again at the beginning of each calendar month, and unused uses do not carry over. We may change allowances on notice in the App.

12.3 Agent plans. Paid plans for agents are sold on our website, not in the App. The price, billing period, and what the plan includes are shown on the website before you pay. A plan renews automatically at the end of each billing period until you cancel. You can cancel at any time in the App under Profile or by writing to support@inspect.ca; cancellation takes effect at the end of the period already paid for.

12.4 Access from work sent to us. An agent whose client completed a qualifying inspection with us in the previous 12 months may receive the full allowance at no charge for that period. We decide what counts as a qualifying inspection. This is a courtesy and may be changed or ended on notice.

12.5 Usage limits. To protect the Services, we apply daily and monthly limits to some tools for all accounts, including free homeowner accounts. When a limit is reached, the tool is unavailable until the limit starts again.

12.6 Payment and taxes. Fees are payable through the payment processor disclosed at checkout. You are responsible for all applicable taxes.

12.7 Refunds. Refunds, where available, are governed by the policy for the Service in question. Strata Review, photo analysis, and similar AI-generated outputs are generally non-refundable once delivered. Nothing in these Terms limits rights you have under consumer-protection law that cannot be waived.

13. Intellectual Property

The Services, including all software, designs, text, graphics, logos, AI models, datasets, trademarks, trade dress, and the “Inspect Canada” brand, are owned by Inspect Canada or its licensors and protected by Canadian and international intellectual property laws. Nothing in these Terms transfers any right, title, or interest in the Services to you, other than the limited licence to use the Services as expressly set out here.

“Inspect Canada”, the Inspect Canada logo, “InspectVault”, and related marks are trademarks of In Spect Building Consultants Inc.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(a) No Indirect Damages. IN NO EVENT WILL INSPECT CANADA, ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) Liability Cap. INSPECT CANADA’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (i) ONE HUNDRED CANADIAN DOLLARS (CAD $100), OR (ii) THE TOTAL AMOUNT YOU PAID INSPECT CANADA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

(c) Excluded Risks. Inspect Canada is not liable for:

  • Any decision you make, or refrain from making, based on AI output, repair estimates, trade recommendations, or Strata Review reports;

  • The acts, omissions, work, advice, conduct, or representations of any third party – including listed trades, third-party inspectors, strata management companies, or referrers – accessed through the Services;

  • Loss or damage caused by force majeure events (natural disasters, pandemics, government actions, network outages, third-party API outages, etc.);

  • Loss or damage caused by your breach of these Terms.

(d) Consumer Rights. Nothing in these Terms limits any non-waivable consumer right under the Business Practices and Consumer Protection Act (BC), the Sale of Goods Act (BC), the Competition Act (Canada), or any other applicable consumer-protection law. Where such law applies, the limitations above apply to the maximum extent permitted by that law.

(e) Some Jurisdictions. Some jurisdictions do not allow the exclusion or limitation of certain warranties or of liability for certain types of damage (such as personal injury caused by negligence, fraud, or wilful misconduct). To the extent that any such law applies to you, the disclaimers and limitations in these Terms apply only to the maximum extent permitted by that law, and the remaining provisions remain in effect.

(f) Home inspections. The disclaimers and limitations in these Terms do not apply to a home inspection performed by a licensed home inspector. Those services are governed by the Inspection Agreement and by the Home Inspector Licensing Regulation, which does not permit a home inspection contract to limit the inspector’s liability.

(g) Allocation of Risk. You acknowledge that the fees (if any) charged for the Services reflect this allocation of risk and that, but for this limitation, the fees would be materially higher or the Services would not be offered.

15. Indemnification

You agree to indemnify Inspect Canada and its directors, officers, employees, and contractors against claims made by third parties, and the reasonable costs of responding to them, to the extent those claims arise from:

(a) User Content you submitted without the right to do so, including strata documents and inspection reports you were not entitled to share;

(b) Your infringement of another person’s rights;

(c) Your unlawful use of the Services; or

(d) Your material breach of these Terms.

This Section does not apply to the extent a claim results from our own negligence, breach, or wilful misconduct. It does not apply to a claim arising from a home inspection we performed. It does not limit rights you have under consumer-protection law that cannot be waived.

If a claim covered by this Section is made, we will tell you promptly. We may take over the defence at our own expense, in which case you agree to cooperate.

16. Termination and Suspension

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms, posed a risk to other Users or our systems, or used the Services in a manner that exposes us to legal liability.

You may stop using the Services at any time. Sections 5, 7, 8.2, 8.3, 11, 12, 13, 14, 15, 16, 17, 18, 19, and 21 of these Terms survive termination.

17. Changes to the Terms

We may update these Terms from time to time. Material changes will be notified through the App, by email, or on our website. Continued use of the Services after the effective date of an updated version constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services.

18. Governing Law and Disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, excluding conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods.

The parties submit to the exclusive jurisdiction of the courts of British Columbia, with venue in Vancouver, B.C., except that Inspect Canada may bring an action for injunctive or other equitable relief in any court of competent jurisdiction.

Before commencing any formal proceeding, you agree to first attempt to resolve the dispute by sending written notice describing the dispute to support@inspect.ca and allowing thirty (30) days for good-faith resolution.

19. Apple App Store Terms (if you obtained the App through Apple)

If you obtained the App through Apple’s App Store, the following additional terms apply between you and Inspect Canada. You acknowledge that these Terms are concluded between you and Inspect Canada only, and not with Apple Inc. Inspect Canada – not Apple – is solely responsible for the App and its content.

  • Scope of Licence. The licence granted to you for the App is a non-transferable licence to use the App on any Apple-branded product that you own or control, as permitted by the Apple Media Services Terms and Conditions.

  • Maintenance and Support. Inspect Canada is solely responsible for any maintenance or support for the App. Apple has no obligation to provide maintenance or support.

  • Warranty. Inspect Canada is solely responsible for any product warranties, express or implied by law, that are not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the App’s purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims relating to the App are Inspect Canada’s responsibility.

  • Product Claims. Inspect Canada – not Apple – is responsible for addressing any claims relating to the App or your use of it, including product liability, regulatory claims, and consumer protection claims.

  • Intellectual Property. In the event of a third-party intellectual-property claim about the App, Inspect Canada is solely responsible for investigation, defence, settlement, and discharge.

  • Legal Compliance. You represent that you are not located in any country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

  • Third-Party Terms. You must comply with applicable third-party terms (for example, your wireless data agreement) when using the App.

  • Third-Party Beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

20. Google Play Terms (if you obtained the App through Google Play)

If you obtained the App through Google Play, your installation and use of the App are also governed by the Google Play Terms of Service. To the extent of any inconsistency for matters specific to Google Play distribution, the Google Play Terms of Service prevail solely for those matters.

21. General

  • Entire Agreement. These Terms, our Privacy Policy, the Inspection Agreement (where applicable), and any other policy referenced in the Services together form the entire agreement between you and Inspect Canada relating to the Services.

  • Severability. If any provision is held unenforceable, the remainder remains in effect.

  • No Waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.

  • Assignment. You may not assign these Terms. We may assign these Terms to an affiliate or in connection with a corporate transaction.

  • Notices. Notices to you may be delivered by email, in-App message, or posting in the Services. Notices to us must be sent to: In Spect Building Consultants Inc., 100 Park Royal S Unit 200, West Vancouver, BC V7T 1A2, Canada, Attn: Legal – copy to support@inspect.ca.

  • Electronic Communications and Consent. You consent to receive communications from Inspect Canada electronically – including by email, in-App message, push notification, and SMS where you have opted in – and you agree that all notices, agreements, disclosures, and other communications we provide to you electronically satisfy any legal requirement that they be in writing. You consent to electronic delivery of records (such as receipts, agreements, and tax documents) and to electronic signature of contracts presented through the Services, in accordance with the Personal Information Protection and Electronic Documents Act (Canada) and the Electronic Transactions Act (BC). This Section is about how we deliver notices and records. It is not consent to promotional messages, which we send only as described in Section 3 of our Privacy Policy.

  • Language. The parties have requested that these Terms be drafted in English. Les parties ont exigé que la présente entente soit rédigée en anglais.
