Inspect Canada — Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you," "your," "User") and In Spect Building Consultants Inc., a British Columbia corporation operating as Inspect Canada ("Inspect Canada," "we," "us," "our"), with offices at 100 Park Royal S Unit 200, West Vancouver, BC V7T 1A2, Canada.

By downloading, installing, accessing, or using the Inspect Canada mobile application (the "App"), the Inspect Canada website at inspect.ca, the Strata Review service at strata.inspect.ca, or any related service (collectively, the "Services"), you agree to these Terms. If you do not agree, do not use the Services.


1. About Inspect Canada

Inspect Canada is a Canadian platform offering technology tools and information services for homeowners, real estate agents, home inspectors, and related professionals. Our Services include — but are not limited to — AI-assisted photo analysis, repair price estimates, trade directory listings, strata document review, home inspection booking, virtual consultations, and digital inspection reports.

Important distinction. Certain Services offered through the platform are informational technology services and do not, by themselves, constitute licensed home inspection, contracting, legal, engineering, real-estate, or strata-management services. A licensed home inspection is performed only when expressly booked as such and conducted under a separate written Inspection Agreement signed by you and the inspector. Outside of that specific inspection-service context, our Services are not the practice of any regulated profession, and use of the Services does not create any professional-client, fiduciary, or agency relationship.

In Spect Building Consultants Inc. does perform licensed home inspections in British Columbia under the Home Inspector Licensing Regulation. Those services are governed by the Inspection Agreement, not these Terms.


2. Acceptance of Terms

You confirm that you have read, understood, and agreed to these Terms by:

If you are using the Services on behalf of a business, brokerage, strata corporation, or other organization, you represent that you have authority to bind that organization to these Terms.


3. Eligibility

You must be at least 19 years of age (the age of majority in British Columbia) to use the Services. By using the Services, you represent that you meet this requirement.

We do not knowingly collect information from anyone under 19. If we learn that a minor has registered an account, we will deactivate it.

You must not be located in, ordinarily resident in, or a national of, any country subject to Canadian or U.S. trade sanctions or embargo, and you must not be on any list of restricted parties maintained by the Canadian or U.S. governments.


4. Your Account

To use most Services, you must register an account using a valid email address, Google account, or Apple ID. You agree to:

We may suspend or terminate accounts that violate these Terms, are inactive for extended periods, are used fraudulently, or otherwise pose risk to other Users or the Services.

You may delete your account at any time from within the App ("Menu → Account → Delete Account") or by emailing support@inspect.ca. Deletion is subject to the retention provisions in our Privacy Policy.


5. General Service Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.

The Services use artificial intelligence (AI), machine learning, and automated computational tools to generate analysis, suggestions, recommendations, estimates, and summaries.

AI Hallucination and Error Acknowledgement. AI output is probabilistic. AI-generated content may contain fabricated, incorrect, incomplete, outdated, biased, or misleading information, including statements that appear authoritative but are not supported by the underlying data, source documents, or real-world conditions. You acknowledge that AI is not a substitute for inspection, evaluation, or advice by a qualified human professional, and that the very nature of generative AI means errors will occur, sometimes without obvious indication. You agree to independently verify any AI output before relying on it for any decision.

Not an Emergency Service. The Platform and Services are not emergency services and must not be used as a substitute for one. In an emergency involving fire, smoke, gas leak, carbon-monoxide alarm, structural instability, flooding, sewage backup, electrical hazard, criminal activity, threat to health or safety, or any other situation requiring immediate response — call 9-1-1 (or your local emergency number) and contact appropriate licensed professionals immediately. Do not wait for AI analysis, a Strata Review, an inspection booking, or any other Service response.

We do not warrant that the Services will be free of defects, viruses, or interruptions, nor that any defects in the Services will be corrected.


6. Service-Specific Terms

In addition to the general disclaimer above, the following terms apply to specific Services. Where multiple Services apply, all relevant disclaimers apply cumulatively.

6.1 Photo Analysis & Defect Detection

The App allows you to upload photos of property components (e.g., siding, electrical, plumbing, mechanical) for analysis by our AI system. The system attempts to identify potential issues, defects, or maintenance items and may suggest trade categories.

6.2 Repair Price Estimates ("RepairPricer")

The App provides estimated cost ranges for repairs identified through photo analysis, AI suggestions, or inspection reports. These estimates are algorithmic approximations derived from public market data, historical averages, and AI inference. They are not produced by a contractor, an estimator, or any licensed professional, and they are not based on physical inspection of your property.

You acknowledge that:

6.3 Trade Directory & Recommendations

The App and the Inspect Canada website list third-party trade professionals (plumbers, electricians, roofers, HVAC technicians, and others). When AI defect analysis identifies an issue, the App may suggest one or more trade categories or specific listings.

No warranty of trade availability or response. Inspect Canada does not guarantee the availability, response time, willingness to take on a job, pricing consistency, geographic coverage, or continued participation of any listed trade. Trades may decline jobs, change pricing, change service areas, become unavailable, or be removed from the directory at any time and without notice.

You are responsible for independently verifying the licensing, bonding, insurance, references, work history, complaint history, and qualifications of any trade you engage before contracting with them, and for obtaining multiple independent written quotes. Inspect Canada strongly recommends checking the trade's standing with the relevant provincial regulator (e.g., Technical Safety BC for gas/electrical, the Canadian Home Builders' Association, the Better Business Bureau) and confirming insurance with a current certificate from the insurer.

6.4 Strata Review

The Strata Review service (available through the App and at strata.inspect.ca) analyzes strata documents you upload — including bylaws, financial statements, depreciation reports, engineering reports, meeting minutes, Form B disclosure statements, and similar — and produces an AI-assisted summary highlighting potential risks, recurring themes, reserve fund status, capital projects, and related observations.

6.5 Home Inspection Booking

The App and our websites allow you to book home inspection services. Home inspections booked through the platform may be performed either by In Spect Building Consultants Inc. (a BC-licensed home-inspection provider) or by independent inspectors operating under their own separate licensing, insurance, and contractual arrangements. The inspector identity will be disclosed before you confirm the booking and in the Inspection Agreement.

6.6 Virtual Inspection / Virtual Consultation

Virtual Consultation sessions ("VC") are live or recorded video sessions with a person identified as an inspector or building consultant. VC sessions provide general guidance and visual observations only.

The Age Finder feature estimates manufacture date of an appliance from a photo of its data/identification plate.

6.8 Inspection Reports & Client Portal

The App may display home inspection reports prepared by Inspect Canada or by inspectors using our InspectVault platform. These reports are governed by the Inspection Agreement signed at the time of the inspection. Nothing in the App alters, replaces, or supplements the report itself.

If the App displays a report prepared by a third-party inspector, Inspect Canada is solely providing a display surface and is not the author of, and is not responsible for, the contents of that report.


7. No Professional Advice, No Reliance, No Fiduciary Relationship

7.1 No Professional Advice

Except where you have engaged us under a separate written professional-services agreement (such as an Inspection Agreement), nothing in the Services constitutes:

You should consult appropriately licensed professionals before making decisions that affect your legal rights, financial position, health, or safety.

7.2 No Reliance

You agree that you use the Services at your own risk and that you assume full responsibility for any decision, action, or inaction taken by you or by anyone acting on your behalf based on Services output. You will not bring any claim against Inspect Canada that depends, in whole or in part, on your reliance on Services output as the basis for a decision.

7.3 No Fiduciary or Agency Relationship

Use of the Services does not create a fiduciary, agency, partnership, joint-venture, employer-employee, advisor-client, or trust relationship between you and Inspect Canada. Inspect Canada owes no fiduciary duty in connection with the Services.

7.4 No Real-Estate Transaction Warranty

The Services are technology and information tools. They are not a substitute for due diligence in a real-estate transaction. Inspect Canada makes no representation, warranty, or guarantee — express or implied — about any property, listing, transaction, counterparty, agent, brokerage, lender, strata corporation, or contractor referenced in or accessed through the Services. Outcomes of real-estate transactions are inherently uncertain. Nothing in the Services constitutes a recommendation to buy, sell, lease, finance, refinance, or insure any property.


8. User Content

"User Content" means any photo, video, document, text, audio, location, contact information, or other content you submit, upload, transmit, or store through the Services — including but not limited to photos uploaded for analysis, strata documents uploaded for review, inspection notes, addresses, and messages.

8.1 Ownership

You retain ownership of your User Content.

8.2 Licence to Inspect Canada

By submitting User Content, you grant Inspect Canada a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, process, copy, transmit, display, and analyze the User Content to the extent necessary to:

We may, but are not obligated to, remove, refuse to host, or terminate access to any User Content that we reasonably believe violates these Terms or applicable law.


9. Acceptable Use and User-Content Safety

9.3 Moderation, Removal, and Reporting

Inspect Canada may, at any time and in our sole discretion, review, remove, refuse to host, label, or restrict access to any User Content we reasonably believe violates these Terms or applicable law, and may suspend or terminate the account responsible. We may also report illegal content to law enforcement or to a regulator.

To report content that violates these Terms — including content you believe is illegal, infringing, abusive, or otherwise objectionable — email support@inspect.ca with the subject line "Content Report", identifying the content and the basis for the report. We aim to respond within 5 business days. Reports about copyright are handled under Section 9.4 below.

9.4 Copyright Notices and Counter-Notices

If you believe your copyright has been infringed by content available through the Services, send a written notice to support@inspect.ca with the subject "Copyright Notice", containing:

Canada's Copyright Act uses a "notice and notice" regime. On receipt of a compliant notice, we will forward the notice to the user responsible for the content (where we can identify them) and retain records of the notice as required by law. We may also remove or restrict the content at our discretion. Repeated or fraudulent notices may result in account suspension or legal consequence under the Copyright Act. A user who has received a notice may submit a counter-notice to the same address.


10. Third-Party Services & Links

The Services interoperate with or link to third-party services, including Apple, Google, Firebase, OpenAI, Google Cloud, and our trade directory partners. Your use of those services is governed by their respective terms and privacy policies. Inspect Canada is not responsible for third-party services.

When you choose to share content (e.g., emailing a Strata Review report or sharing an inspection report), Inspect Canada is not responsible for what the recipient does with that content.


11. Referring Agents, Inspectors, Brokerages, and Third-Party Distributors

The Services may be shared, promoted, recommended, distributed, co-branded, or — in some cases — white-labelled by real-estate agents, brokerages, home inspectors, contractors, strata management companies, lenders, insurers, or other third parties (collectively, "Referring Parties"). A Referring Party may appear in the App as the inspector or agent who "shared" the App with you, may have their branding displayed in your account, or may have provided you with a link or QR code to download the App.

You acknowledge and agree that:

Limitation of Referring Party Liability. To the maximum extent permitted by applicable law, no Referring Party will have any liability arising from or related to your use of the Services, the Services themselves, or any Service output. Each Referring Party is an intended third-party beneficiary of this Section and Section 14 (Limitation of Liability) and may enforce these provisions directly.

Your Own Direct Relationship. Nothing in this Section affects any direct contract you have with a Referring Party for services that party performs in their own name — for example, a buyer's-agent representation agreement, a home-inspection contract you sign with a specific inspector, or a brokerage's listing agreement. Those direct relationships are governed by their own separate agreements.

12. Fees

Most features of the App are currently free. Some Services — including home inspection booking, Strata Review, and premium features — may incur fees. Where fees apply, the fee, taxes, and payment terms will be displayed before you confirm a transaction.

Fees are payable through the payment processor disclosed at checkout (e.g., Stripe, Apple Pay, Google Pay, or our invoicing partner). You are responsible for all applicable taxes.

Refunds (where available) are governed by the specific policy for the Service in question. Strata Review, photo analysis, and similar AI-generated outputs are generally non-refundable once delivered.


13. Intellectual Property

The Services, including all software, designs, text, graphics, logos, AI models, datasets, trademarks, trade dress, and the "Inspect Canada" brand, are owned by Inspect Canada or its licensors and protected by Canadian and international intellectual property laws. Nothing in these Terms transfers any right, title, or interest in the Services to you, other than the limited licence to use the Services as expressly set out here.

"Inspect Canada", the Inspect Canada logo, "InspectVault", and related marks are trademarks of In Spect Building Consultants Inc.


14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(a) No Indirect Damages. IN NO EVENT WILL INSPECT CANADA, ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) Liability Cap. INSPECT CANADA'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (i) ONE HUNDRED CANADIAN DOLLARS (CAD $100), OR (ii) THE TOTAL AMOUNT YOU PAID INSPECT CANADA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

(c) Excluded Risks. Inspect Canada is not liable for: - Any decision you make, or refrain from making, based on AI output, repair estimates, trade recommendations, or Strata Review reports; - The acts, omissions, work, advice, conduct, or representations of any third party — including listed trades, third-party inspectors, strata management companies, or referrers — accessed through the Services; - Loss or damage caused by force majeure events (natural disasters, pandemics, government actions, network outages, third-party API outages, etc.); - Loss or damage caused by your breach of these Terms.

(d) Consumer Rights. Nothing in these Terms limits any non-waivable consumer right under the Business Practices and Consumer Protection Act (BC), the Sale of Goods Act (BC), the Competition Act (Canada), or any other applicable consumer-protection law. Where such law applies, the limitations above apply to the maximum extent permitted by that law.

(e) Some Jurisdictions. Some jurisdictions do not allow the exclusion or limitation of certain warranties or of liability for certain types of damage (such as personal injury caused by negligence, fraud, or wilful misconduct). To the extent that any such law applies to you, the disclaimers and limitations in these Terms apply only to the maximum extent permitted by that law, and the remaining provisions remain in effect.

(f) Allocation of Risk. You acknowledge that the fees (if any) charged for the Services reflect this allocation of risk and that, but for this limitation, the fees would be materially higher or the Services would not be offered.


15. Indemnification

You agree to indemnify, defend, and hold harmless Inspect Canada and its directors, officers, employees, contractors, agents, licensors, and affiliates from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees on a solicitor-and-own-client basis) arising out of or related to:

(a) Your use of, or inability to use, the Services;

(b) Your User Content, including any claim that User Content infringes a third party's rights or that you lacked authority to submit it (in particular, strata documents and inspection reports);

(c) Your breach of these Terms or violation of applicable law;

(d) Any decision made or action taken by you, or by a third party at your direction, based on Services output;

(e) Any dispute between you and a third party (including a listed trade, third-party inspector, agent, brokerage, strata corporation, or counterparty in a real estate transaction).

Inspect Canada reserves the right, at our own expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, in which case you agree to cooperate.


16. Termination and Suspension

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms, posed a risk to other Users or our systems, or used the Services in a manner that exposes us to legal liability.

You may stop using the Services at any time. Sections 5, 7, 8.2, 8.3, 11, 12, 13, 14, 15, 16, 17, 18, 19, and 21 of these Terms survive termination.


17. Changes to the Terms

We may update these Terms from time to time. Material changes will be notified through the App, by email, or on our website. Continued use of the Services after the effective date of an updated version constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services.


18. Governing Law and Disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, excluding conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods.

The parties submit to the exclusive jurisdiction of the courts of British Columbia, with venue in Vancouver, B.C., except that Inspect Canada may bring an action for injunctive or other equitable relief in any court of competent jurisdiction.

Before commencing any formal proceeding, you agree to first attempt to resolve the dispute by sending written notice describing the dispute to support@inspect.ca and allowing thirty (30) days for good-faith resolution.


19. Apple App Store Terms (if you obtained the App through Apple)

If you obtained the App through Apple's App Store, the following additional terms apply between you and Inspect Canada. You acknowledge that these Terms are concluded between you and Inspect Canada only, and not with Apple Inc. Inspect Canada — not Apple — is solely responsible for the App and its content.

20. Google Play Terms (if you obtained the App through Google Play)

If you obtained the App through Google Play, your installation and use of the App are also governed by the Google Play Terms of Service. To the extent of any inconsistency for matters specific to Google Play distribution, the Google Play Terms of Service prevail solely for those matters.
